GENERAL MEMBERSHIP CONDITIONS

1. Scope and Object

These general terms and conditions of membership are intended to regulate the terms and conditions governing the use and provision of services on the electronic public procurement platform – ComprasPT (compraspt.com/). ComprasPT is managed by MIROMA – Serviços e Gestão de Participações, Lda. which owns all the intellectual property rights of this platform.

These terms and conditions of membership must be read by all users before accessing the platform. By signing up to ComprasPT’s services, the customer declares that they have read, understood and accepted all the general conditions expressed in this document.

2. Access Conditions

ComprasPT offers a set of basic services that include access to all the essential functionalities for operating the platform and for the full development of pre-contractual public procedures, at no cost to the Economic Operator.

The client must appoint a user responsible for handling all matters relating to the use of the platform and the management of digital certificates, at an administrative, technical and financial level.

Access to the platform is granted once the customer has registered and all their details have been confirmed and validated. Access to ComprasPT is by logging in with the user’s digital certificate.

3. Basic Services

The basic services that ComprasPT offers include access to all the essential functionalities that enable the full and complete development of public pre-contractual procedures, namely:

a) Access to published procedures and procedural documents;

b) Sending messages via the electronic platform;

c) Sending e-mails to all those involved in the public procurement procedure in progress, whenever, under the terms of the CCP, such communication is mandatory;

d) Requests for clarification and lists of errors and omissions;

e) The submission of applications, proposals and solutions;

f) Pronouncements at prior hearings;

g) Complaints and challenges;

h) The award decision;

i) Submission of qualification documents;

j) Viewing all the messages and notices created by the Contracting Authorities to which, under the terms of the law, you must have access. Access to ComprasPT’s basic services is granted to Economic Operators registered on this platform.

Access to ComprasPT’s basic services is granted to Economic Operators registered on this platform and includes 3 users (accesses) free of charge, in accordance with the legislation in force.

4. Support Services

ComprasPT provides customer service and technical support on a continuous basis, during office hours from 9am to 7pm on working days. Users are served through different communication channels: telephone, email and online chat.

5. Security

The ComprasPT platform follows the highest security, integrity and information availability metrics and standards. Being duly compliant with international security best practices and standards ISO/IEC 27002/27001, CobiT, NIST, Sarbanes-Oxley, ITIL and Basel II, it ensures real added value for the entire user community.

6.Use of the ComprasPT Platform

ComprasPT meets the needs imposed by Decree-Law no. 18/2008 of 29 January, which approves the Public Contracts Code, amended and republished by Decree-Law no. 111-B/2017 of 31 August and rectified by Rectification no. 36-A/2017 of 30 October and Rectification no. 42/2017 of 30 November, and by the law regulating the provision and use of electronic public procurement platforms (Law no. 96/2015 of 17 August).

The platform can be used via an internet browser, based on secure communication over the HTTPS (HyperText Transfer Protocol Secure) protocol. The confidentiality of information is guaranteed by the encryption of all transacted information.

The use of ComprasPT (https://compraspt.com/) involves uploading, storing, downloading and sending information, the content of which is the sole responsibility of users.

7. Rights and Obligations

7.1 ComprasPT’s obligations towards the Client:

7.1.1. ensure that the client has access to all the information on the technological conditions and technical requirements necessary to operate with the platform;

7.1.2 Guaranteeing a secure authentication process, as well as the confidentiality of information, through a process of submitting encrypted and signed documents, using Qualified Digital Certificates and chronological validation;

7.1.3 Guaranteeing the integrity of information, through processes that prevent destruction, loss, diversion, violation of access and modification, illegitimate or unauthorised exposure;

7.1.4 Ensuring the operation and monitoring of the application infrastructure;

7.1.5 Ensuring the supervision of information security and safeguarding procedures.

7.2 The Customer’s relationship with ComprasPT:

7.2.1 Ensuring that all users comply with the general conditions of membership of ComprasPT described in this document;

7.2.2 Not publishing, sending or allowing the sending of any defamatory, illegal or abusive information through the platform;

7.2.3. guarantee the confidentiality of access data and prevent any possible misuse, taking full responsibility for its use by third parties when accessing the services provided by ComprasPT;

7.2.4. not jeopardise the security of the network, namely by sending or transmitting viruses, worms or other bugs via the platform or other techniques that could jeopardise its proper performance;

7.2.5. report, within a maximum of 24 hours, any anomalies of which they become aware, such as the loss, transmission or any breach of their access data.
8. Privacy

The personal data provided by the Client/User is intended for the management of ComprasPT/MIROMA’s Clients and Services, as well as for marketing new ComprasPT/MIROMA services.

Under the terms of Regulation (EU) 2016/679 of the European Parliament and of the Council – General Data Protection Regulation (GDPR) – and other applicable national legislation on privacy and data protection, in particular Law no. 58/2019 of 8 August, which ensures the implementation of that Regulation in the national legal order, Customers/Users are guaranteed access to their data and may request in writing that MIROMA consult, rectify or update it, as well as request at any time that their data not be used for marketing purposes.
